  10. IMPORTANT-READ CAREFULLY: This End-User License 
  11. Agreement ("EULA") is a legal agreement between you 
  12. (either an individual or a single entity) and The 
  13. Active Data Recovery Software for the Active@ 
  14. UNERASER for DOS later referred to as 'SOFTWARE'. 
  15. By installing, copying, or otherwise using the 
  16. SOFTWARE you agree to be bound by the terms of this 
  17. EULA. If you do not agree to the terms of this EULA, 
  18. do not install or use the SOFTWARE.

  20. WE REQUIRE ALL OUR DEALERS TO PROVIDE EACH PURCHASER
  21. WITH FREE DEMO OF THE SOFTWARE TO GET A FULL 
  22. UNDERSTANDING OF THE CAPABILITIES AND THE EASE OF USE
  23. OF THE SOFTWARE. OUR DEALERS HAD TO RECOMMEND YOU TO 
  24. DOWNLOAD DEMO. WE WON'T ISSUE ANY REFUNDS AFTER 
  25. PURCHASING FULL VERSION OF THE SOFTWARE.

  27. Active Data Recovery Software may have patents, 
  28. patent applications, trademarks, copyrights, or other
  29. intellectual property rights covering subject matter 
  30. in this document. The furnishing of this document 
  31. does not give you any license to these patents, 
  32. trademarks, copyrights, or other intellectual 
  33. property.

  35. SOFTWARE LICENSE 
  36.  
  37. 1. The SOFTWARE is licensed, not sold. Copyright laws
  38. andinternational copyright treaties, as well as other
  39. intellectual property laws and treaties protect the 
  40. SOFTWARE.
  41.  
  42. 2. GRANT OF LICENSE.
  43.  
  44. (a) FREE DEMO COPY.  You may use the DEMO SOFTWARE 
  45. without charge on an evaluation basis to backup MBR, 
  46. create disk images, scan drives for deleted partitions, 
  47. logical drives and files, and preview their contents.
  48. You must pay the license fee to get commercial 
  49. version of the product that can save restored 
  50. files and folders back to the HDD.

  53. (b) REDISTRIBUTION OF DEMO COPY.  If you are using 
  54. DEMO SOFTWARE on an evaluation basis you may make 
  55. copies of the DEMO SOFTWARE as you wish; give exact 
  56. copies of the original DEMO SOFTWARE to anyone; and 
  57. distribute the DEMO SOFTWARE in its unmodified form 
  58. via electronic means (Internet, BBS's, Shareware 
  59. distribution libraries, CD-ROMs, etc.). You may not 
  60. charge any fee for the copy or use of the evaluation
  61. DEMO SOFTWARE itself, but you may charge a 
  62. distribution fee that is reasonably related to any 
  63. cost you incur distributing the DEMO SOFTWARE (e.g. 
  64. packaging). You must not represent in any way that 
  65. you are selling the software itself. Your 
  66. distribution of the DEMO SOFTWARE will not entitle 
  67. you to any compensation from Active Data Recovery 
  68. Software. You must distribute a copy of this EULA
  69. with any copy of the Software and anyone to whom you
  70. distribute the SOFTWARE is subject to this EULA.

  72. (c) REGISTERED COPY.  After you have purchased the 
  73. license for SOFTWARE, and have received SOFTWARE 
  74. distribution package, you are licensed to copy the 
  75. SOFTWARE only into the number of floppy disks
  76. corresponding to the number of licenses purchased.  
  77. Under no other circumstances may the SOFTWARE be 
  78. operated at the same time on more than the number 
  79. of floppy disks for which you have paid
  80. a separate license fee. You may not duplicate the 
  81. SOFTWARE in whole or in part, except that you may 
  82. make one copy of the SOFTWARE for backup or archival
  83. purposes. You may terminate this license at any time
  84. by destroying the original and all copies of the 
  85. SOFTWARE in whatever form.  You may permanently 
  86. transfer all of your rights under this EULA provided
  87. you transfer all copies of the SOFTWARE (including 
  88. copies of all prior versions if the SOFTWARE is an 
  89. upgrade) and retain none, and the recipient agrees 
  90. to the terms of this EULA.

  93. 3. RESTRICTIONS.  You may not reverse engineer, 
  94. decompile, or disassemble the SOFTWARE, except and 
  95. only to the extent that such activity is expressly
  96. permitted by applicable law notwithstanding this 
  97. limitation. You may not rent, lease, or lend the 
  98. SOFTWARE. You may permanently transfer all of your 
  99. rights under this EULA, provided the recipient 
  100. agrees to the terms of this EULA. You may not use the
  101. SOFTWARE to perform any unauthorized transfer of 
  102. information (e.g. transfer of files in violation of a
  103. copyright) or for any illegal purpose.

  106. 4. SUPPORT SERVICES. Active Data Recovery Software 
  107. may provide you with support services related to the
  108. SOFTWARE. Use of Support Services is governed by the
  109. Active Data Recovery Software polices and programs 
  110. described in the online documentation and web site, 
  111. and/or other Active Data Recovery Software-provided 
  112. materials, as they may be modified from time to time.
  113. Any supplemental software code provided to you as part
  114. of the Support Services shall be considered part of 
  115. the SOFTWARE and subject to the terms and conditions 
  116. of this EULA. With respect to technical information 
  117. you provide to Active Data Recovery Software as part 
  118. of the Support Services, Active Data Recovery 
  119. Software may use such information for its business 
  120. purposes, including for product support and 
  121. development. Active Data Recovery Software will not 
  122. utilize such technical information in a form that 
  123. personally identifies you.

  125. 5. TERMINATION. Without prejudice to any other 
  126. rights, Active Data Recovery Software may terminate 
  127. this EULA if you fail to comply with the terms and 
  128. conditions of this EULA. In such event, you must 
  129. destroy all copies of the SOFTWARE.

  132. 6. COPYRIGHT. The SOFTWARE is protected by copyright
  133. law and international treaty provisions. You 
  134. acknowledge that no title to the intellectual 
  135. property in the SOFTWARE is transferred to you. 
  136. You further acknowledge that title and full ownership
  137. rights to the SOFTWARE will remain the exclusive 
  138. property of Active Data Recovery Software and you 
  139. will not acquire any rights to the SOFTWARE except as
  140. expressly set forth in this license. You agree that 
  141. any copies of the SOFTWARE will contain the same 
  142. proprietary notices which appear on and in the 
  143. SOFTWARE.

  145. 7. DISCLAIMER OF WARRANTY. Active Data Recovery 
  146. Software expressly disclaims any warranty for the 
  147. SOFTWARE. THE SOFTWARE AND ANY RELATED DOCUMENTATION
  148. IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, 
  149. EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT 
  150. LIMITATION, THE IMPLIED WARRANTIES OR 
  151. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
  152. OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF
  153. USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU.

  155. 8. LIMITATION OF LIABILITY. IN NO EVENT SHALL ACTIVE
  156. DATA RECOVERY SOFTWARE OR ITS SUPPLIERS BE LIABLE TO 
  157. YOU FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR
  158. INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE 
  159. DELIVERY, PERFORMANCE, OR USE OF THE SOFTWARE, EVEN 
  160. IF ACTIVE DATA RECOVERY SOFTWARE HAS BEEN ADVISED OF
  161. THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, ACTIVE
  162. DATA RECOVERY SOFTWARE'S ENTIRE LIABILITY UNDER ANY 
  163. PROVOSION OF THIS EULA SHALL BE LIMITED EXCLUSIVELY 
  164. TO PRODUCT REPLACEMENT.
